Cybrary.IT Terms and Conditions (“Agreement”)
By creating an account on Cybrary, you fully agree to adhere to the following terms.
Please read these Terms and Conditions (“Agreement”, “Terms and Conditions”) carefully before using http://www.Cybrary.IT (“the Site”) operated by Cybrary Inc (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at http://www.Cybrary.IT. By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you (“User”) agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.
Ethics: Cybrary is not responsible for any damage or legal repercussions resulting from improper use of knowledge presented on our site. Before penetration testing any systems that are not your own or those that you do not have explicit written consent from the owner of the systems, you agree to check and adhere to all local laws and regulations regarding computer crimes, and penetration testing before performing any tests or actions demonstrated here. The knowledge presented here on Cybrary is not intended for use in any illegal capacity and is meant to aid learning and development of Cyber Security and Information Technology practices and concepts only. The knowledge conveyed in this site is to be used by you to help advance the function and effectiveness of the Cyber Security industry through research, contribution, development and improvement. You agree to fully comply with “White Hat” hacking / security / penetration testing practices and any damage caused by your application of any Cyber Security knowledge gained from Cybrary or otherwise, is solely your responsibility, and not the responsibility of Cybrary Inc or its instructors.
Intellectual Property: The Site and its original content, features and functionality are owned by Cybrary IT and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.
Proper Use and Spam: If the Site determines that an account is being used for any purpose other than online IT and Cyber Security learning, the Site reserves the right to disable or delete the account without notice.
Termination: We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Cybrary Teams: Cybrary Teams is intended to be for the assignment and reporting of educational development. By joining a Cybrary Team you are agreeing to allow the Team Admin, and the Team Admin alone, of the Team you have requested to join, and subsequently join, to track and report on your site activity including, but not limited to: login activity, lesson and video progress, 0p3n content viewership, s3ss10n content viewership, ch4nn3l content viewership. You are also agreeing to share with the Team Admin, and the Team Admin alone, the email that is connected with your Cybrary account.
Cybrary Teams – Billing:An active Cybrary Teams Monthly Recurring Billing Account, will be billed on a monthly basis under this plan. The Cybrary Teams account can be canceled at any time and will remain active for the duration of the subscription and a prorated refund will not be issued. Accounts can be upgraded at any time. When upgrading an account, the Team Admin will need to unsubscribe from the current subscription then subscribe to the higher level of service. During this time, accounts will be locked until the upgrade has occurred. The Cybrary Team will refund the original subscription amount within 48-72 hours, as long as the account re-subscribes to a higher level of service. Subsequent months will then be billed at the upgraded account amount.
Cybrary Teams Refund Policy: PAYMENTS ARE NONREFUNDABLE AND THERE ARE NO REFUNDS OR CREDITS FOR PARTIALLY USED PERIODS. You must cancel your Cybrary Teams account before it renews in order to avoid billing of the next month’s membership fees to your Paypal account.
Cybrary CH4NN3LS is intended for cyber security and IT product or service companies to have a presence on Cybrary through the use of a branded company page; and, the ability to post company updates and content on your company’s behalf. By creating a Cybrary CH4NN3L you agree to the following guidelines as they pertain to the creation, maintenance, and termination of the Service.
In order to create a Cybrary CH4NN3L, your company’s representative should complete the form found on www.cybrary.it/create-CH4NN3L. Cybrary will utilize the information provided from the “Create CH4NN3L Form” and the information associated with the user account that initiated the request to determine to legitimacy of the company and the user’s association with the company. By creating a CH4NN3L, you are accepting these Terms and using the service on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so.
If Cybrary is unable to determine the legitimacy of the request, either from the “Create CH4NN3L Form” or the user associated with the request, Cybrary reserves the right to deny the request. If a request is denied, a person and/or company reserves the right to submit an additional request and his/her behalf.
All submitted requests will require an approval by the Cybrary organization. Cybrary reserves the right to approve or deny any request.
If you believe you have been undeservedly denied a request to create a CH4NN3L, please contact firstname.lastname@example.org.
Once a company has been approved by Cybrary, the user that initiated the request will receive an email within 48 business hours with information to get started with his/her CH4NN3L. All approved CH4NN3Ls are created at the Free level service and in offline mode. The following presents the features available at each package. Cybrary reserves the right to adjust the criteria and features available within each category. All CH4NN3L administrators will be notified before any such modification occurs.
Free level packages include:
• Create a Branded Company Page
• Ability for Users to follow the CH4NN3L
• Add a banner and logo
• Post and share company updates at will
• Company page and update engagement analytics
• Feature sponsored content directly within your company CH4NN3L and content
• Manage company admins
Basic level packages include:
• Increased onsite exposure within the Homepage & CH4NN3L feeds
• Connect your blog’s RSS feed to simplify the process of keeping your content fresh, and followers up to date
Plus level packages include:
• Expanded analytics dashboard
• Webinar and Event Promotion
• Weekly Newsletter Features
• Post full blog posts, video tutorials, whitepapers, SlideShares, etc.
• Social Promotion through Cybrary’s social CH4NN3Ls
• Your Training Course on Cybrary’s Course Catalog
Please note, at this time, all Plus level packages are handled through the Cybrary Sales Team. Intention to purchase this package indicates that you agree to the Cybrary Sales Team using the information tied to your Cybrary user account to contact you.
Exposure of company content and status updates is controlled by Cybrary and Cybrary reserves the right to adjust its algorithms at any time.
RSS Feed: Use of the RSS feed feature permits Cybrary to connect to the feed and pull content at will. Control of the number of posts and timing in which the script is run is maintained and controlled by Cybrary.
Content on the Services: Users of the CH4NN3L product are responsible for the use of the service and for any Content you provide, including compliance with applicable laws, rules, and regulations. You should only provide Content that you are comfortable sharing with others. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. All Content is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content.
We reserve the right to remove Content alleged to be infringing without prior notice, at our sole discretion, and without liability to you. We will respond to notices of alleged copyright infringement that comply with applicable law and properly provided to us, as described in our Copyright policy.
You retain your rights to any Content you submit, post or display on or through the Services. What’s yours is yours — you own your Content (and your images and videos are part of the Content).
By submitting, posting or displaying Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed). This license authorizes us to make your Content available to the rest of the world and to let others do the same.
As of 12/1/16, upon initial set up of the RSS feed, the last 3 posts are pulled ad-hoc from the designated link. Subsequent requests are run every 12 hours and return any new posts from the designated link. Any posts pulled from the RSS feed can be deleted, at any time, from the Manage Content Tab.
If a company determines that a CH4NN3L has been created and believes the creation and administration of the company page is a false representation or violates the terms of the company’s branding policies, please contact email@example.com and a Cybrary representative will assist in taking immediate action. Cybrary is not responsible for CH4NN3Ls created and/or approved without the authorization of a company, organization, government or other legal entity you claim to represent.
Billing: The varying packages are priced as advertised. Basic Level packages will pay on a monthly subscription rate. Initial payment will take place upon activation of the paid service, and subsequent payment will be billed every 30 days until the CH4NN3L client opts out of the service.
If payment is not received on the date of renewal, Cybrary reserves the right to keep the service online or remove it, at will.
All payments are final and nonrefundable.
Note: Each service is provided with an option to turn Online/Offline. Moving your Service to Offline mode, does not trigger a subscription to be canceled. A paying CH4NN3L will continue to be billed even if it is in Offline mode.
Downgrading a CH4NN3L: If you would like to downgrade a CH4NN3L please contact Cybrary at firstname.lastname@example.org and a representative will work with you and your organization.
Deleting a CH4NN3L: If you would like to delete a CH4NN3L please contact Cybrary at email@example.com and a representative will work with you and your organization.
Guarantees: Cybrary does not guarantee leads, saves, shares, likes, followers, views, or any other associated engagement as a result of the service.
Any additional inquiries or concerns can be addressed to firstname.lastname@example.org. Please submit your inquiry or concern prior to the creation of a team, and a Cybrary representative will assist you.
This concludes specific information pertaining to the Terms of Service as it relates to the CH4NN3LS service.
Limited License: Cybrary IT grants you a non-exclusive, non-transferable, limited license to use the Site in accordance with this Agreement.
Limitation Of Liability: In no event shall Cybrary IT, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for damages, direct or consequential, resulting from your use of the Site, and you agree to defend, indemnify and hold us harmless from any claims, losses, liability costs and expenses, including but not limited to attorney’s fees, arising from such use and/or your violation of any third-party’s rights.
Warranty Disclaimer: Your use of the Site is at your sole risk. The Site is provided on an “as is” and “as available” basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Cybrary IT, its subsidiaries, affiliates, and its licensors do not warrant that a) the Site will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Site is free of viruses or other harmful components; or d) the results of using the Site will meet your requirements.
Governing Law: This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the State of Maryland, United States, without giving effect to any principles of conflicts of law.

Changes To This Agreement: We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions. Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site and/or discontinue any use of the Site immediately.
